Any sign represented or capable of being represented graphically may be considered as trademark, provided that such sign is capable of distinguishing the goods of the same kind of one undertaking from those of other undertakings.

Trademarks are words, designs, ornaments, combinations of colours, the three-dimensional shape of goods or of their packaging, as well as melodies or other acoustic signals.

The trademark certificate is granted for 10 years from the date of the filing of the application and the term may be extended for the next 10 years.

Patent Office provides a wide range of services in order to protect trademarks:

• trademark registrability searches in domestic and international databases and preparing reports
• filing trademark applications with the Polish Patent Office, the Office for Harmonization of the Internal Market of the European Union (OHIM), the International Bureau of the World Intellectual Property Organization (WIPO) as well as with other foreign Patent Offices

• proceedings related to trademarks infringement
